Terms of Service

1. Agreement

By creating an account or using ApiLink's API services, you agree to these Terms of Service. If you are using ApiLink on behalf of a company, you represent that you have authority to bind that company.

ApiLink Limited ("ApiLink") is incorporated in New Zealand. These terms are governed by the laws of New Zealand.

2. The Service

ApiLink provides access to third-party AI model APIs through a unified endpoint. You send requests to our gateway; we route them to upstream AI providers (OpenAI, Anthropic, Google, and others) and return the responses.

We are a reseller, not an AI provider. The AI outputs are generated by third-party providers. Their terms and acceptable use policies apply in addition to ours.

3. Accounts and API Keys

  • You are responsible for maintaining the confidentiality of your API keys.
  • All usage under your API key is your responsibility, including unauthorized use due to key compromise.
  • You must immediately revoke and replace any key you believe has been compromised.
  • One person or legal entity may not maintain more than one free account.

4. Billing and Credits

  • ApiLink uses a prepaid credit model. You add credits to your account and they are consumed as you make API calls.
  • Credits are charged in USD. Prices shown are per 1 million tokens.
  • Credits do not expire, but may be forfeited if your account is terminated for Terms violations.
  • We reserve the right to change prices with 14 days' notice. Price changes do not affect credits already purchased.
  • No refunds on consumed credits. Unused credit balance may be refunded within 14 days of purchase; contact support@apilink.io.
  • Minimum top-up amount is $5 USD.

5. Acceptable Use

You may not use ApiLink to:

  • Generate content that is illegal in New Zealand or your jurisdiction
  • Create, distribute, or facilitate CSAM or content that sexualizes minors
  • Generate targeted harassment, threats, or hate speech
  • Build systems designed to deceive people into thinking they are talking to a human
  • Conduct cyberattacks, generate malware, or assist unauthorized system access
  • Circumvent rate limits or attempt to access other users' data
  • Resell API access without written authorization from ApiLink

Violations may result in immediate account termination without refund.

6. Rate Limits and Fair Use

We apply rate limits to ensure fair access for all users. Current limits are displayed in your dashboard. We reserve the right to throttle or suspend accounts that abuse the service, generate unusual traffic patterns, or violate upstream providers' terms.

7. Uptime and Service Level

We target 99.5% monthly uptime for the API gateway. We do not guarantee uptime of underlying AI providers. Scheduled maintenance will be announced with at least 24 hours' notice.

We are not liable for outages caused by upstream AI providers (OpenAI, Anthropic, Google, etc.).

8. Data and Privacy

Your use of the service is also governed by our Privacy Policy, which is incorporated into these Terms.

We do not store the content of your API requests or AI responses. We log only metadata (model, token counts, cost, timestamp, status).

9. Intellectual Property

You retain all rights to content you submit via the API. AI-generated outputs are subject to the terms of the respective AI provider.

ApiLink retains all rights to its platform, documentation, and software.

10. Limitation of Liability

To the maximum extent permitted by New Zealand law:

  • ApiLink provides the service "as is" without warranty of any kind
  • ApiLink is not liable for indirect, incidental, or consequential damages
  • Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim
  • We are not responsible for the accuracy, legality, or quality of AI-generated content

11. Termination

You may close your account at any time from Account Settings. We will delete your personal data within 30 days per our Privacy Policy.

We may suspend or terminate accounts that violate these Terms, with or without notice depending on severity.

12. Changes to Terms

We may update these Terms. Material changes will be communicated by email at least 14 days in advance. Continued use after the effective date constitutes acceptance.
